RAFFLE RULES AND REGULATIONS

1.      This raffle is conducted by the Lee’s Summit Educational Foundation (the “Foundation”), located at 301 NE Tudor Road in Lee’s Summit, MO 64086. The Foundation is a non-profit organization under Internal Revenue Code Section 501(c)(3), and permitted to conduct this raffle pursuant to Mo. Const. art. III, § 39(f). All proceeds, less expenses, will support the Foundation’s mission.

2.      The raffle will be conducted from September 15, 2024 to *October 20, 2024 with tickets available for purchase while quantities last through 11:59 p.m. on October 20th (the “Entry Period”).  The Foundation reserves the right to sell a limited number of tickets on the day of the drawing if any are available.

*UPDATE 10/17/24: Raffle has been extended. Tickets will be sold up until 8:00 a.m. CST on Thursday, October 24, 2024.

3.      A maximum of 300 tickets will be sold at $100 per ticket. The odds of winning a first, second, or third place prize are dependent on the number of valid entries up to 300 during the Entry Period.

 

4.      How To Enter:

a.   Purchasers of tickets must complete the Foundation’s online entry form in its entirety along with associated payment in order to be eligible.

b.   Payment for the tickets shall be made online by credit card or debit card. All purchases are final and no refunds will be issued.

c.   Only one name shall be listed on the ticket.  If more than one name is listed on the ticket, the first name listed shall be considered the “entrant.” The Foundation shall, will and can have no obligation for delivery of any prize to any person other than the entrant.

d.   Minors may not purchase or have their names identified as entrants for prizes.

 

5.      The Drawing:

a.        Winners will be picked by random drawing to be held between 8:00 am - noon on October 24, 2024. (the “Drawing”).

b.   Winners need not be present to win. Winners will be contacted within 24 hours of the drawing.

c.   For a list of winners - available after October 28, 2024, send a self-addressed stamped envelope, received by November 22, 2024 to:

d.   Prizes to be given away in the raffle include:

                                          i.    1st Prize:  Choice of one vacation package pre-selected options as coordinated through third party (Mitch Stuart)

                                         ii.    2nd & 3rd Prizes will also be awarded

 

6.      Claiming the Prize:

a.   Winners must present winning raffle ticket within 30 days of the Drawing.  Winner must provide one form of picture identification. Delivery of the prize shall be made solely to the entrant based on providing the raffle ticket receipt, picture identification, and, when required, a social security number/tax ID number and completion of a W-9.

b.   If the winner cannot be reached at the phone number, email address or mailing address on the ticket order for any reason by within 30 days of the Drawing, a disqualification will result, and an alternate winner will be drawn.

 

7.      General Rules:

a.   All Entries and prize claims become the property of LSEF and will not be returned.

b.   Except where prohibited, by accepting a prize, winners consent to the use by LSEF and its designees of their names and/or photographs for advertising and publicity purposes.

c.   By participating in this promotion, each entrant accepts and agrees (i) to be bound by these Official Rules and the decisions of LSEF, which shall be final and binding in all respects, and (ii) to release LSEF and their directors, officers, employees and agencies (collectively, the "Released Parties") from any and all liability of any injuries, losses or damages of any kind caused by participating in this raffle or resulting from acceptance, or use/misuse of the prize.

d.   LSEF reserves the right at its sole discretion to disqualify any individual that tampers or attempts to tamper with the entry process or the operation of the raffle or website, violates the Official Rules, or acts in any unsportsmanlike or disruptive manner, or with intent to annoy, abuse, threaten, or harass any other person.

e.   Winners acknowledge that the Foundation, its staff, Board of Directors, its agents and representatives have not made and neither are they in any manner responsible or liable for any warranty, representation or guarantee expressed or implied in fact or in law, relative to any prize, including but not limited to its quality, mechanical condition or fitness for a particular use.

f.     Winners are subject to all Federal and State tax regulations and payment of applicable taxes are the sole responsibility of the winners. The Foundation will report winnings to the appropriate federal and state taxing authorities, as required by Federal and State tax regulations.

g.   A copy of all rules and eligibility requirements will be posted in the Foundation office, as well as on our website.

h.    The decision of the Foundation Director and the LSEF Board of Directors shall be in accordance with these Rules and Regulations, and shall otherwise be final on all matters concerning the raffle.

i.      Each entrant agrees that: (1) any and all disputes, claims, and causes of action arising out of or in connection with this promotion, or any prizes awarded, shall be resolved individually, without resorting to any form of class action, and any judicial proceedings shall take place in a federal or state court within the state of Missouri; (2) any and all claims, judgments, and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering this raffle, but in no event attorneys' fees; and (3) under no circumstances will entrant be permitted to obtain awards for, and entrant hereby waives all rights to claim punitive, incidental, and consequential damages, and any other damages, other than for actual out-of-pocket expenses, and any and all rights to have damages multiplied or otherwise increased.

j.      All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or the rights and obligations of entrant and Sponsor in connection with the promotion, shall be governed by, and construed in accordance with the laws of the State of Missouri, without giving effect to any choice of law or conflict of law, rules or provisions (whether of the State of Missouri, or any other jurisdiction), that would cause the application of the laws of any jurisdiction other than the State of Missouri.

k.    IN NO EVENT SHALL SPONSOR, DONOR, OR THE RELEASED PARTIES BE LIABLE TO ANY ENTRANT OR WINNER FOR DAMAGES THAT EXCEED THE VALUE OF THE PRIZE TO BE AWARDED TO ANY INDIVIDUAL ENTRANT IN THIS RAFFLE.

 

8.      Eligibility: 

a.   This raffle is only open to legal residents of the states in which its residents are permitted to partake in raffles under the applicable law, and who are 18 years of age or older as of the date of entry and purchase a raffle ticket from the Lee’s Summit Educational Foundation. Eligibility is subject to all applicable Federal, state and local laws. Void where prohibited.

b.   The employees of the Foundation, its Board of Directors and their spouses and children living in the same household, and the Foundation’s consultants, attorneys, accountants and their spouses are excluded from participating and are not eligible to win.

c.   LSR7 District Administrators, its Board of Education and their spouses and children living in the same household are excluded from participating and are not eligible to win.
